Fox News [You must be registered and logged in to see this link.] that Arias' attorneys are seeking to have the jury's decision about the "especially cruel" manner of the murder vacated. If successful, this would take the death penalty option of sentencing off the table.
Arias' attorneys say that the definition of "especially cruel is too difficult to be determined by jurors who don't have the legal experience to decide what constitutes an "especially cruel."
However, prosecutors argue that this motion challenges a Supreme Court ruling that says a defendant has the right to have a jury, not a judge, decide on the factor that makes a defendant eligible for the death penalty.
Judge Sherry Stephens, who presided over the original trial, gave Arias' attorneys until Aug. 8 to file motions supporting their argument. A status conference to discuss the issue is scheduled for Aug. 28.
"It appears there are a number of issues that are unresolved so I am reluctant to set a firm trial date for the penalty phase retrial," Stephens said. "Parties should work toward beginning trial in late September. That is my intention."
[You must be registered and logged in to see this link.], when the second jury is chosen for the sentencing phase, both the prosecution and defense will spend a good amount of time presenting evidence to get the new jury up to speed on the previous five-month-long trial.
If the second jury is unable to decide upon Arias' sentencing or if the prosecution decides not to go for the death penalty a second time, then Stephens would sentence Arias to prison for life - either with or without the possibility of parole.

This is just ridiculous. How can the defense get the jury's decision vacated on especially cruel murder?

If JA were to come to a plea deal, she wants the option for getting out on parole. If she'd agree to LWOP, I'm betting Juan Martinez and the Alexander family would be okay with that. At least you would know that she dies in prison...this is one woman who should never walk among the free..

The sad thing about this case is if JA gets life she will continue to hurt the family with her twitter nonsense and anything else she can get out of the prison. She lost her privledge to live among civilized people and really needs to have all and any opprotunities to speak about anyone or anything for the public to hear or see. 23 hours in 1 hour out, JA might want to use her hour for other things instead of hurting the Alexanders. Arias was in Maricopa County Superior Court briefly Monday morning, but Judge Sherry Stephens told the attorneys that she had not had time to decide on the other motions before her in the case, and so she set a date of Sept. 16 to hear oral arguments on the matters.

Defense attorneys for convicted killer Jodi Arias filed a motion Tuesday asking that her retrial for sentencing be moved to another venue because of the notorious publicity surrounding the case.

The defense attorneys, Kirk Nurmi and Jennifer Willmott, have three other motions before the court, all of which have to do with media coverage and undue publicity, which they feel denies Arias the right to a fair trial. Coverage of the trial went viral, through live-streamed broadcasts of day-to-day hearings and an aggressive national TV audience and social media, including blogs, Facebook and Twitter that brought interest and obsession from around the world.

One of the defense motions asks that the attorneys be provided the Twitter handles of any future jurors, since it came to light that at least one of the jurors in the first trial had been in contact with a journalist through Twitter and was copied in Twitter exchanges about whether Arias had a bad temper because she is part Hispanic.

Nurmi and Willmott also filed motions to allow them individualized questioning of prospective jurors to assess how much they have already been influenced by media coverage, including a made-for-TV movie with many fictionalized scenes that has aired several times.

Jodi Arias Trial Update: Mysterious Settlement Conference Scheduled for October 24

Maricopa County Superior Court records show that a settlement conference between convicted murderer Jodi Arias and prosecutors is scheduled for Oct. 24 and may be a sign that neither side wants to go through with a retrial of the sentencing phase of the trial, according to the Arizona Republic.

PHOENIX -- Jodi Arias, who has been convicted of first-degree murder in the 2008 death of her boyfriend, Travis Alexander, but has not yet been sentenced, filed motions in Maricopa County Superior Court this week to fire her main defense attorney.

Arias said Tuesday in a 12-page handwritten narrative that her lead attorney, Kirk Nurmi, had not seen her since May 23, the day the jury reached an impasse on whether to sentence her to life or death. She claimed that she attempted to fire him in June, as well, but Judge Sherry Stephens did not grant her request.

Arias writes that Nurmi has an "utter poverty of people skills" and "has little to no tolerance for my emotional and psychological shortcomings."

PHOENIX (AP) -- Live television coverage of Jodi Arias' penalty phase retrial will be banned and the case will remain in Phoenix despite defense arguments that intense publicity will make it difficult to find impartial jurors, a judge ruled this week.

The judge also banned the use of all electronic devices inside the courtroom, meaning reporters won't be able to use Twitter, as occurred during the first trial, to deliver the public real-time updates.

She also denied a defense motion to sequester the jury for the duration of what is expected to be a two-month trial.

No retrial date has been set.

Jodi Arias needs money for her legal fees, and hopes her followers can buy plenty of rubber band bracelets to help her out.


The 33-year-old, who was found guilty of murdering her boyfriend Travis Alexander and is awaiting sentencing, has started selling “Jodibands” to followers in the hopes to raise money for her defense.

PHOENIX (Reuters) - An Arizona judge on Monday set a March court date for retrial of the penalty phase in the sensational murder case of Jodi Arias, who was convicted last year of killing her ex-boyfriend at his home in a Phoenix suburb.

After finding Arias guilty of the 2008 murder of Travis Alexander, a Maricopa County jury last May deadlocked on the question of weather the 33-year-old California waitress should be put to death or be sentenced to life in prison.

The case has since been delayed by legal maneuvering, including a failed bid by defense attorneys to have the case moved out of the Phoenix area because of the widespread publicity.

But on Monday, Maricopa County Superior Court Judge Sherry Stephens ordered that jury selection for the retrial of the penalty phase begin on March 17.

PHOENIX — Convicted murderer Jodi Arias will again face a potential death sentence after a judge’s ruling cleared the way for a second penalty phase in the case.

Defense attorneys had argued that the Arizona law allowing a retrial of the penalty phase is unconstitutional and should be considered cruel and unusual punishment, while amounting to double jeopardy.

In her ruling made public Friday, Judge Sherry Stephens denied the defense motion.

“Arizona’s capital scheme has been found to be constitutional by the United States Supreme Court and the Arizona Supreme Court,” Stephens wrote.

Arias’ retrial is set for March 17. Arias, 33, was convicted of first-degree murder in May, but the jury couldn’t reach a verdict on her sentence.

Under Arizona law, while her murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury.

If the second panel fails to reach a unanimous decision, the death penalty will automatically be removed from consideration, and the judge will sentence Arias to spend her entire life behind bars or to be eligible for release after 25 years.

“Defendant has not been ‘acquitted’ of the death sentence by the jury’s failure to reach a verdict, and thus there is no constitutional bar to retrying the penalty phase,” Stephens wrote in her ruling.

Defense attorneys did not return a telephone message seeking comment Friday. Prosecutors declined comment.

Arias admitted that she killed her boyfriend, Travis Alexander, in 2008 at his suburban Phoenix home but claimed it was self-defense. He suffered nearly 30 knife wounds, had his throat slit and was shot in the forehead. Prosecutors argued it was premeditated murder carried out in a jealous rage when Alexander wanted to end their affair.

Arias’ legal bills for her court-appointed attorneys, expert witnesses and other fees have cost taxpayers about $2.2 million, according to Maricopa County officials. Prosecutors have declined to provide a tally of how much it has cost to prosecute the case, citing a court order that attorneys not discuss Arias-related matters.

In a hearing Tuesday in Maricopa County Superior Court, Presiding Criminal Judge Joseph Welty ruled the trial of a man accused of killing a Phoenix-area police officer in 2007 will go first. It's the oldest capital murder case in the county awaiting trial.

Juan Martinez is prosecuting the new case. The State Attorney said that Ms Arias has been convicted and this new case takes priority over her sentencing......lol

PHOENIX – A member of Jodi Arias' defense team is no longer banned from visiting her clients in Phoenix jails.

Mitigation specialist Maria De La Rosa had been banned since last Friday for taking a pencil drawing by Arias out of the jail last month.

Maricopa County Sheriff's officials say the drawing is contraband and De La Rosa cannot deliver things for Arias.

The ban was lifted after a telephone conference Wednesday involving lawyers for Arias and De La Rosa and the MCSO and County Attorney's Office.

Arias' artwork was presented in her first sentencing trial. Her lawyer says the confiscated drawing is of potential use in the mitigation case.

Arias was convicted in May of first-degree murder in the 2008 killing of her boyfriend. The case's penalty phase starts in September.

Arias was convicted of murder last year for the 2008 killing of her lover in Arizona, but jurors couldn't reach a decision on a sentence.

Under state law, while her murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury in an effort to secure a death sentence.

lol twee. I know how you feel but she does keep me entertained. Now she will have no one to blame but herself for the outcome. I would kill to watch her go up against Juan. That will be epic.
