"A hearing in the Arias capital murder trial begins at 12:30 pm ET. It appears the defense is alleging prosecutorial misconduct and plans to call a friend and former co-worker of Travis Alexander to support its claim. The friend, Gus Searcy, also knows Arias. The jury returns tomorrow to hear the first witnesses in the defense case."

JA has such a smirk on her face. I'm glad that the prosecution lit into that guy, you can see he is a scuzball. This prosecution witness put the defense in their place. I love it.

The defense needs time to prepare for cross-examination of a witness they didn't expect, so testimony in the prosecutorial misconduct hearing will resume tomorrow, Tuesday, at 10:15 AM. Judge said the jury will be there at 10:30, so I assume the trial will still continue tomorrow. Another witness for the hearing will also testify tomorrow at 3:30 PM tomorrow.

Did the defense just jump from the pan into the fire with this? I also don't believe the defense was so nieve that they didn't expect the prosecution to rebut their accusation of misconduct with out witness's. Please...

Now that defense attorneys have said Arias did shoot Alexander, the only question is which account jurors believe.

"The truth can always be somewhere in between," said Laurie Levenson, a professor at Loyola Law School in Los Angeles and a former federal prosecutor.

Levenson said the defense will attempt to explain away everything.

In one scenario, Levenson said, defense lawyers could say Arias brought the gun from her grandparents' house but only for protection if Alexander got abusive, not to kill him. They could say she changed her stories out of fear, thinking no one would believe her, and that she was in shock after the killing so she didn't call police.

"She just needs one, just one juror to have reasonable doubt," Levenson said. "For the defense, it's going to be a victory if she doesn't end up with the death penalty."

Jodi Arias' will unlikely die by lethal injection, even if she is found guilty of murder, said a Los Angeles criminal defense attorney that does not represent her.

As the prosecution in Arias' murder trial is fighting to ensure that she becomes the fourth woman in Arizona's history to be sent to death row for the horrific murder of her lover Travis Alexander, a legal defense expert is confident that even if she is charged, she will not receive capital punishment because she lacks a criminal record.

"She has no criminal past," Los Angeles Criminal Defense Attorney Dana Cole told Radar Online. "Normally we like to reserve the death penalty for really the worst of the worst - it is unlikely."

While Cole agrees that the crime "was a very vicious attack" and that the "sheer viciousness could in fact warrant the death penalty," he explained that Arias' "lack of criminal record" will make it "unlikely" she will receive the death penalty.

"It is very rare unless the defendant is a really hated person, and to warrant such deep hatred they really would have had to have lived a life of crime," Cole added.

They can try that but the prosecution can come back with who drive's all those miles to meet up with an abusive BF.

BULLSHIZZLE!!! We learned during the FCA trial that a jury has to be DP quilified (as it was not in that case imo) in other words if the crime fit's the punishment you need to be able to sentence the defendant to the DP or you need to keep your can off the jury.

thanks eveyone.....was in and out all day....did see parts of the hearing.....I too think the next witness with be Skye Hughes. But since the Hugh's seem very pro prosecution, why would the defense call her?

I believe she did kill him so he wouldn't go to cancun with another woman and she may very well have thought that his body wouldn't be discovered immediately. Maybe she thought that by rinsing off the body in the shower that it wouldn't smell. Do you know if the room mates were also going to Cancun?

I don't believe that JA thought too much past just killing him and thinking that no one would think it was her because she would have an aliby (so she thought).

Can't wait for the defense to start their arguement today, I hope that prosecutor tears each of their witnesses apart.

after the info from that blog was reported on NG .. the info that TA might have broken JA's finger etc (first she denied it to her ex, but when he pushed for more answers ... she finally admitted it to him etc) in one of his "angry outbursts" ... and that her ex will more likely have to testify about it (even though he didn't really want to) etc ..., Nancy Grace said that this might the the first time "we heard something" to go along with JA's claim that she was abused....

As on killing TA, she killed him, i believe, of course, because he was going to Cancun with another woman, rather than with her ... however ... I am not sure about "she thought his body would not be discovered cuz they'd think he was in Cancun" ... BECAUSE ... wasn't he due to go to Cancun the next day .. or in a couple of days or something like that?
If so then his travel partner would surely troubleshoot about him being absent ... at the the very least, on the day before or on the day they were to travel to Cancun.

Below is a link to the transcript of last night's Nancy Grace show. Note the underlined parts of the quotes I have selected--what the ex-paramour said is heresay. It looks like the little miss will have to testify to what was said and done--or not--herself.

GRACE: You know, Jean Casarez, a story reared its ugly head that there is a witness that saw Arias with some bruises on her hand, possibly a broken finger, maybe a bruise on her neck, and that after a lot of coaxing that she said -- Jodi Arias said that Travis Alexander had left those bruises on her. What do we know about that?

JEAN CASAREZ, LEGAL CORRESPONDENT, "IN SESSION": This is what we know. A former boyfriend of Jodi Arias`, they dated about two years, I believe he`s from northern California, and according to some writing that he may have done on a blog, he saw Jodi one day and she had a broken finger and she had finger marks that were in red on her neck.

He asked her what happened. She blamed it on a seat belt, but he kept pushing her and pushing her and she finally says that it was Travis. And he said, why don`t you stay away from him? And she said, I try but he just won`t let me.

GRACE: And will this ex-boyfriend, yet another man that apparently is under her spell, will he testify?

CASAREZ: It appears as though he might. He told the defense he didn`t want to come anywhere near the trial, did not want to be a part of it, but it appears as though he may be a witness for the defense.

GRACE: Now, Jean Casarez, that is the very first thing I`ve heard so far that would lend any credence whatsoever to her claim that she was battered by him, that he had beaten her in the past. I still don`t see the logistics of that day she was under attack so this was self-defense. But this blogger sounds like the first person that could put any skin on the bones of that claim.

ALEX SANCHEZ, DEFENSE ATTORNEY: It is hearsay, but it is permissible hearsay, plus it comes in to -- comes in under the theory of subject to connection, meaning it first comes in and then once she testifies, she can confirm that that particular conversation had taken place.

Travis was brutally murdered by Arias on June 4, 2008--she is pleading self-defense, not denying that she murdered him. She, herself, has not given a reason for her cruel actions.

The trip to Cancun was scheduled for June 10. Marie Hall, the friend that he had asked to accompany him became very worried on the evening of the 9th because she hadn't heard from Travis in the past week, and she wasn't positive that their trip was still 'on'--so she went to his home.

Only then was Travis discovered--late in the evening of the 9th.

Discovery and investigation

Alexander had scheduled a trip to Cancun, Mexico with Marie (Mimi) Hall and others from Pre-Paid Legal Services. He had also missed an important conference call on the night of June 4, 2008 at 7pm. After Mimi and others could not reach Alexander, they went to his home to check on his welfare on June 9, 2008. His roommates indicated that he was out of town. After some searching, they located a key to Alexander's master bedroom. Upon entry, they noticed large pools of blood at the hallway leading to the master bathroom, where his body was discovered in the shower.[13] He had been shot and repeatedly stabbed.

The 9-1-1 call notifying authorities of the discovery made mention of an ex-girlfriend that Alexander had told friends was stalking him, hacking into his Facebook account, and slashing tires.[14] Arias and many of Alexander's friends voluntarily gave fingerprint and DNA samples to Mesa Police.

Arias began calling the Detective assigned to the case, Esteban Flores, inquiring on details and offering assistance. While knowing Alexander was dead, she claimed that she had no knowledge of the crime declaring that she had last seen him in April 2008.

Prior to the discovery of his remains, Arias continued to leave voicemails for Alexander. She stated that Travis was to visit her in May 2008 but that plans changed. A white Ford Focus was rented by Arias some 300 miles south of her residence in Redding, California. Her initial trip was to head south to photograph a friend's child and then to Utah to spend time with her new love interest, Ryan Burns. Arias has alleged that Alexander called her in the early hours of June 4 and persuaded her to go see him in Arizona. Her arrival at his home was approximately 4am on June 4, 2008.

A spent .25 caliber round was located near one of the sinks in the master bath. Alexander's, heavily damaged, digital camera was located in the downstairs washing machine. Although images had been deleted, Mesa Police were able to recover the images. The recovered images included Arias and Alexander, both in sexually suggestive poses at approximately 1:40pm on June 4, 2008. The last photo of Alexander alive, and in the shower, was taken at 5:29:20 pm on June 4, 2008. Moments later, images appear of an individual, believed to be Alexander, "profusely bleeding" on the floor.[15][16] The attack on Alexander began at approximately 5:30pm on June 4, 2008.

A bloody palm print was located on the bathroom hallway, which DNA revealed to be a mixture of Arias's and Alexander's DNA. Arias continued to insist that she had last seen Alexander in April 2008 despite being presented with DNA and photographic evidence by Detective Esteban Flores.[15][17] On May 28, 2008, an "odd" burglary occurred at the residence of Arias's grandparents, with whom she was living, in Yreka, California. One object, each worth very little, was taken from every room of the home while cash and other valuable items were not taken. Arias's grandparents had guns in the home, which Arias denied knowing the existence of. Four firearms were in a gun cabinet but only a .25 caliber gun, same caliber as the firearm used to shoot Alexander, was taken. The whereabouts of the gun and knife used in the crime are unknown. They were not recovered at the scene.[18]

Ryan Burns and others who met up with Arias in Utah, after the murder, indicated she had bandages on her hands and that she wore long sleeves on days it was very hot. She told different stories about how she received the cuts to her hands. Burns was told they were from an injury while working at Margaritaville. At trial, it was revealed by Siskiyou County, California authorities that no such restaurant exists, nor ever existed in the area. At the time of the murder, she worked at Casa Ramos in Yreka..[19]

It seems this 'Gus' character thinks he has some explosive information. Personally, I don't think it is as important as he thinks, as he wasn't even called as a witness in the State's case in chief. I do not believe that the prosecutor overlooked anything.

And he claimed that he has some piece of information that could either hurt Jodi`s case, or it could set her free and her complete case could be resolved.

So nobody knows what that piece of information is, but we do know that he is on the witness list for the defense. And he could possibly be called tomorrow, and we don`t know what he`s going to say. But according to him, he has some bombshell he`s going to drop that is going to change this case around.

If the witness is Skye, it may be because she sent the e-mail to her husband; who then e-mailed that Gus character to see what was up with him being on the witness list. (And this is just for the prosecutorial misconduct hearing, I think.)

She should be called first thing today, before the jury enters and before the 'trial' starts.

Travis was scheduled to leave for Cancun the day of his autopsy... Many "talking heads" have reported his trip date incorrectly. Talking heads want high ratings so they just fill there shows with BS and tall tales (just look at the links supplied by Darkman) No offense to you Darkman. It's the media who is doing this. We can really only go by the trial; and truth is we will probably never know the whole truth. JMOO The only truth we will know is that JA killed Travis and I do not believe she was abused I call BS. As OneWonders stated, who the hell drives all that way to be abused!

The Master tells the slave to come and she comes ... after all she is Travis's (or was it Alexander's), as the T-short indicated :)
