Seems that James has taken to spitting at the corrections officers who have to move him about the jail. There are also questions as to whether James is suffering from some form of mental illness or just faking it.

For someone to go into a theater and mass kill, you obviously have to have some form of mental illness going on. Question is, is it serious enough that he was not capable of knowing right from wrong? I doubt it.
I am for our 2nd amendment rights. But people should not be able to randomly purchase ammunition, combat gear or explosives over the internet. My goodness, some states require you to buy your alcohol from the Government - but you can buy this stuff on line? Doesn't make sense.

Good Morning America is reporting that James' Public defenders visited his apartment yesterday. Apparently some of the surviving victims are wishing no ill-will toward James, feeling that he is a "lost soul."
I will admit that it is hard to have the type of disgust for James, as I would for a defendant such as GZ, because obviously the man has some mental issues. But I am afraid I would not be able to be as forgiving as some of the victims appear to be. Another thing is, there is no conflict on whether or not what James did was wrong or deserves punishment - it will just be an issue as to what extent based upon what a mental workup discloses.

"Denver Rescue Mission employee Pierce O'Farrill was shot three times, in the left arm and left leg, in the attack Friday at an Aurora theater showing the new Batman movie. He was released from the hospital Wednesday.
James Eagan Holmes is accused of launching the attack that killed 12 people and injured 58.
O'Farrill told The Denver Post (http://bit.ly/NYVEBq ) that when he saw images of Holmes at his first court appearance Monday, he felt sorrow for him.
"Of course, I forgive him with all my heart. When I saw him in his hearing, I felt nothing but sorrow for him — he's just a lost soul right now," O'Farrill said. "I want to see him sometime. The first thing I want to say to him is 'I forgive you,' and the next is, 'Can I pray for you?'"

According to knowledgeable sources, reports that Holmes was spitting at guards in jail are "simply false."
Two national news organizations have reported that Holmes, who is being detained in solitary confinement, has been acting out at the Arapahoe County Jail. One national news organization also reported Tuesday night that Holmes has been put in a headgear to prevent him from spitting at guards.
However, knowledgeable sources tell CALL7 Investigator John Ferrugia that is just not true.

AURORA, Colo. (KABC) -- Three hospitals taking care of people wounded in the movie theater shooting in Aurora, Colo., say they will limit or completely wipe out medical bills for the victims.
Some of the victims are uninsured and face mounting hospital bills.
Children's Hospital Colorado said it would use donations to cover the medical expenses of the uninsured. For those who do have insurance, the hospital said it will waive all co-pays for shooting victims.
HealthOne, which owns the Medical Center of Aurora and Swedish Medical Center, also said it will limit or eliminate charges based on the individual circumstances of the patients.

Motion filed by defense requesting discovery concerning the federal and state law enforcement agents who were were aware of or involved in the investigation of the package Holmes allegedly sent to a psychiatrist/professor at C.U., details of which were leaked to the media.

In the motion, Holmes' defense attorneys state they want the names of law enforcement officials who examined the contents of the package and may have leaked information to the news media in violation of a gag order issued by a judge barring police, prosecutors and the defense team from releasing details of the criminal investigation.
The defense motion says the leaks are a breach of Holmes' confidential and privileged communication with his doctor and violate his constitutional rights to due process and a fair trial.
The defense asked a judge to order prosecutors to "immediately produce" all information about the seizure of the package, including any law enforcement officials "involved in the seizure or handling of the material in question in any way."
But Arapahoe County Senior Deputy District Attorney Richard Orman's written response to the defense motion said inaccuracies in the Fox News reports about the notebook indicate that whoever provided the information didn't know the facts of the case.

Hmmmm, thanks for this Tamta. I have a bot of mixed feelings about this. Given the apartment of Holmes, the governement had ever right to test the package for hazardous material and explosives, but I have to wonder, since it was addressed to a doctor, why would they read the contents knowing it was privledged info?

There were conflicting reports about whether the package reached the school in time to potentially prevent the massacre, but officials remained tight-lipped due to a strict gag order imposed by the judge overseeing the case.

I have a bit of an issue with "privledged info" in relation to anyone but your lawyer. But that is just me. I realize that it is okay to tell your doc and your religious advisor whatever you want and it is confidential.
But think about this (and btw, I just discussed this with hubby and he told me I was nuts).
If doctors were allowed to divulge past medical records of Holmes, the Columbine shooters, Timothy McVeigh (OK City Bombing) and other mass murderers, maybe they could find the common denominator that made them who they are and could help to identify others with the same propensities and stop them before they act. I dunno....just a thought and waaaaaay off topic...lol

"The faculty and program leadership meet on a regular basis to discuss how the student' doing, the stars and difficult students," said the university's dean, Barry Shur.
A package sent by Holmes to Dr. Fenton was recovered by police in the school mailroom on Monday. Sources say the package contained a letter written by Holmes that described shooting people. It's unclear when Holmes sent the package.
Holmes' lawyers say the discovery of the letter should never have been made public because it contained "...communications from Mr. Holmes to Dr. Fenton that Mr. Holmes asserts are privileged."

However, "Care should be taken not to confuse such mental disease or defect with moral obliquity, mental depravity, or passion growing out of anger, revenge, hatred or other motives, and kindred evil conditions," the law stipulates, the AP said.
The court schedule suggests that Holmes will not file a plea in case until at least the week of Nov. 12, NBC's Mike Taibbi reported. The schedule allows for deliberation on how much evidence will remain sealed from public view, including communications between Holmes and a psychiatrist at the University of Colorado.
