What I heard the Judge say at the end of this morning's session was, "Court will reconvene at 1:15 with a sealed hearing involving Ms. LaV, and I will make a decision on the 702a/Daubert (Motion for Mistrial) at that time." Someone in Chat mentioned that the jury is to be back at 1:30pm so I am assuming they will conduct the sealed hearing and resume the trial on 1:30pm - whether Ms. LaV will be up again or whether she is just involved in the sealed hearing - dunno.

I just don't get the point Nurmi was trying to make. Of course Jodi had two hands on the camera, I doubt that she had a knife in one hand while taking the picture with the other. That would have given Travis heads up of what she was about to do and I'm sure he would have put up a better fight by being more prepared.

I don't remember anyone at all saying that Jody wasn't holding the camera with both hands while taking the picture. Also, if she had both hands on the camera that would have indicated that she didn't drop the camera as she says. If anything she threw the camera to the floor when she took out the knife, she would have needed both her hands to handle Travis while stabbing him.

I think the same way Martinez is thinking, the defense is just stalling to rack up more hours and I'm so happy that Martinez told the judge that today. If anyone has been taking abuse it's Martinez from Nurmi and Wallmott, they just don't like it when Martinez strikes back. Wallmott objects every two seconds yet gets annoyed when Martinez objects. The defense wants this case to be one sided only (their side) and it pizzes them off because Martinez is not going to sit for that.

There is just no way Nurmi thinks he is going to get a mis trial or get Martinez removed. I think the judge is just pacifying the defense by letting them wait for a decision. Too many hours have been paid out by tax payers money to get a mis trial at this stage of the game.

I think this defense got used to the income they have been receiving for this case and is just trying to drain every penny they can.

THis whole day of court was a waste of time and money. The defense is also mad because Martinez is destroying all the defense witnesses and rightfully so. Not one decent credible witness has been produced by the defense as of yet.

If Jodi's story is corroborated by prooving that she had both hands on the camera then the defense really has absolutely nothing to go with. We know she took the picture of Travis, we know she had both hands on the camera, and we know she shot and stabbed Travis to death. So what am I missing here?

Was I wrong in understanding last Friday that Ms. LaV's testimony was over - both sides rested as to her. Then the Court ordered Ms. LaV to be back on Monday or Tuesday - the choice was hers to deal with an issue that was pending. She mumbled something about her having tests on Monday and the Judge said, don't tell me about your personal matters, you are still under subpoena so you will be back here on Monday or Tuesday, the choice is yours.

So whatever is going on involving Ms. LaV, IMO, has to be something with inappropriate behavior - whether it has to do with her CV, her testimony, or her conduct in speaking with the victim's family. Any one of these could result in her testimony being stricken and the jury instructed not to give it consideration - kinda like unringing the bell - but it still could happen.

Okay - CB, see at the bottom of this thread? It doesn't show who is viewing this thread - how do we adjust it so that that information shows for the members?

So, did I miss anything?

After all that crap.....and after and hour and a half of waiting, they called the jury in and the Judge said......"The defense and the prosecution are stipulating that Jodi was not holding a gun or a knife when the photo (the close up of his face) was taken."

Court dismissed until 9:30 (AZ time) tomorrow morning. 12:30 EST

Okay that was the Daubert hearing. Wonder what went down with Ms. LaV. Damn, I hate secrets. LOL

OT - I am asking why we cannot have a "who's on line" at the bottom of each thread - showing, who is on the current thread. Other Forumotion sites have that and we don't. If you don't know how to do it, I thought I would go to the "help" section and see if we have those capabilities.
