Re: Andrea Sneiderman Discussion Thread #1
DECATUR, Ga. (AP) — A judge has sentenced Andrea Sneiderman to a five-year prison term, and will allow her to get credit for the time she's already served.
That means Sneiderman will spend about a year behind bars for lying to authorities who were investigating the slaying of her husband.

She should have been sentenced an additional five years for unnecessary display of arrogance in the courtroom, imo.

Lawyers for Sneiderman talked Tuesday of seeking an appeal and getting her before the parole board in as little as two months.
“We believe we have multiple grounds for appeal,” said Doug Chalmers, one of the lawyers, who will work on the appeal with Atlanta defense attorney Brian Steel. “This is a fight Andrea Sneiderman is going to win.”

Hey Friends, 5 years with 1 served, a little vomit in the mouth on that one. I'm pretty hardup for some justice and I will have to settle with that sentence. A real tear or two would have been nice. I got up real close to the big TV set and looked really hard, not one, just a blubbering honker of a nose... URG... and on we go warriors.

Sneiderman prosecutor discusses case, what's next
--video@link
•Prosecutor Robert James sat down HLN's Evening Express to talk about Sneiderman case
•He discusses the verdict, the sentence and whether murder charges could be filed in future
[Only admins are allowed to see this link]
What's next for Andrea Sneiderman?
-snip--
A shortened prison stay?
Although Sneiderman received a five-year sentence, she most likely won’t spend anywhere near that long behind bars. The judge gave her credit for time-served for about a year she spent under house arrest, which reduces the sentence to approximately four years right out of the gate. But legal experts like former prosecutor Tanya Miller say it's possible she could be out in less than a year.
“With an offense like this, that’s low severity, she’s not at high risk to re-offend,” Miller told HLN’s Vinnie Politan. “I would imagine she’ll serve well less than half of that [five years] -- maybe a third or less.”
Once Sneiderman serves her time, she may not have to worry about having felonies on her permanent criminal record, either. According to Darren Kavinoky, a criminal defense attorney, Sneiderman is considered a “first offender.” Under Georgia’s “First Offender Act,” she could have the convictions removed from her record once she leaves prison. This would mean an employer wouldn’t be able to use her convictions against her down the road.
“That [law] affords her the opportunity, when she’s out of custody, to have everything expunged, just sweep it under the rug,” Kavinoky said. “But obviously in the court of public opinion, it’s a very different story. She’s been tried and convicted and has been convicted by some as having a role in the murder itself. But that’s another story.”
~~
A pending civil suit
The family of Rusty Sneiderman, Andrea's late husband, filed a civil suit against the widow about a year ago, and it is set to go into effect 30 days from the day she was sentenced. The Sneidermans are going after the money that Andrea received from Rusty’s life insurance policy. The $2 million was initially frozen when Sneiderman was arrested, but it is unclear what happens to that money while Sneiderman is in prison.
~~
According to Esther Panitch, the attorney for Rusty Sneiderman's family, if Andrea Sneiderman does file an appeal, the civil suit will likely be temporarily discontinued, since an appeal process could take years.
Her two young children
During her statement at her sentencing hearing, Sneiderman begged for leniency for the sake of her children.
“Please let me go home to my kids. Since last August, they’ve had no parent to join them at school events, to take them to the playground or to go have an ice cream, all because the state wrongly charged me with murder that I had nothing to do with and would do anything to undo," Sneiderman told the judge.
Sneiderman’s children -- Sophia, 7, and Ian, 4 -- have been living with her at her parents’ house. According to Panitch, the Sneidermans have reached out to Andrea’s lawyers and are “hopeful” they can reach an agreement that’s in the best interest of the children. Since Rusty’s death, the Sneidermans have been unable to gain custody of their grandchildren.

Media Statement
Media Statement
We are relieved that the criminal portion of our pursuit for Justice For Rusty is now complete. Rusty has had his day in court and we are grateful that a lawfully appointed jury returned with NINE felony convictions against the defendant. The Jury has spoken and we determined that we have no choice but to continue to litigate the pending civil lawsuits against the defendant to the fullest extent possible under the law. Accordingly, we can make no further comment on the defendant or her actions.
We want to be sure to thank District Attorney Robert James and his dedicated team of Kellie Stevens Hill, Anna Green Cross, Andy Pasqual, Craig Scott, Mark Potter, Marva Coward and former ADA Don Geary, as well as the many other people in the office who worked both of these cases for their commitment to the fight for Justice For Rusty. These are people who never met my brother but who set aside their own lives to learn all about this complicated case and stand up and fight for him, all the while treating our family with warmth, respect and dignity.
Our family will never recover from losing someone as unique and beloved as Rusty Sneiderman. We will press on, as we have no other choice. We are now left with the hard work of finally grieving his loss and attempting to rebuild our shattered lives. We will do so through the support of our family and true friends, who have stood by us every day throughout this ordeal and for whom we are forever in their debt.
Finally, we ask each and every one of you who hears this statement to take a moment to remember Rusty, his shining smile, his relentless optimism, his big heart and his love for family and friends everywhere and try to take a small piece of that positive energy and pass it forward in the world. That is the best way to preserve the true legacy of his life and push the tragedy of his untimely death and its sad aftermath off the page once and for all.

Sneiderman’s lawyers file for new trial; Neuman’s attorneys plan similar action
--snip--
One day after she was sentenced to five years in prison, Andrea Sneiderman’s attorneys have filed a motion for a new trial.
Meanwhile, lawyers for Sneiderman’s former boss, Hemy Neuman — convicted of killing her husband, Rusty, outside a Dunwoody day care facility in November 2010 — say they will also seek a new trial, citing Sneiderman’s conviction Monday on nine of 13 felony counts, including perjury, making false statements to investigators and hindering the apprehension of a criminal.
The motion on behalf of Sneiderman, filed late Tuesday afternoon in Fulton County Superior Court by her new attorney, Brian Steel, contends the verdict against her was “contrary to the evidence and without evidence to support it.”
A separate motion was filed Tuesday by Steel requesting bond pending an appeal, which Sneiderman’s counsel intends to seek.
~~~
Neuman’s lawyers are also optimistic, citing Sneiderman’s conviction.
“Hemy Neuman was convicted in part by perjured testimony,” attorney Bob Rubin said.
Co-counsel Doug Peters said they expect to file a motion for a new trial within 60 days. DeKalb County Superior Court Judge Gregory A. Adams will hear that motion and, if he rejects it, Peters said they’ll seek a ruling from an appellate court.
